TERRAGNAR LIMITED WARRANTY

This limited warranty covers TerraGnar (“TerraGnar”) products and rack components manufactured by TerraGnar and extends to the original end user purchaser (“original purchaser”) who uses the products for personal, family, or household use for the time periods from the date of purchase or date of delivery (if later than the date of purchase) specified below. The Warranty Period begins on the earlier of (a) the date you receive the product, as shown by carrier records, or (b) 10 days after shipment, unless you provide proof of a later delivery date.

This warranty terminates when the original purchaser sells, gifts or otherwise transfers the product to any other person. This warranty applies only to the original end-user purchaser and is non‑transferable. Because TerraGnar cannot control the quality of products sold by unauthorized sellers, this warranty applies only to products purchased in the United States directly from TerraGnar. Purchases from other sources are not covered. TerraGnar reserves the right to reject warranty claims for products purchased from unauthorized sellers, including unauthorized internet sites.  This limitation applies to the fullest extent permitted by applicable law.

Taking your product to be serviced by a third-party will void this warranty. Using third-party parts will void this warranty. Any parts that are used and/or installed on your TerraGnar product that are not genuine, unmodified TerraGnar parts are not covered by this Warranty. Any damage that result from the use and/or installation of parts on your TerraGnar product that are not genuine, unmodified TerraGnar parts are not covered by this Warranty.

This Limited Warranty constitutes the entire agreement with respect to warranty coverage for TerraGnar products and supersedes all prior or contemporaneous warranty representations, whether written or oral. If any provision of this Limited Warranty is held invalid or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect.

REMEDIES UNDER THIS WARRANTY

Subject to inspection and in its sole discretion, TerraGnar will, at its option, repair or replace the product. If the original product is unavailable, TerraGnar may replace it with a comparable model of equal or greater value. If repair or replacement is not commercially practicable or cannot be made within a reasonable time, TerraGnar will refund the purchase price. TerraGnar’s options are limited to these remedies. TerraGnar is not responsible for delays in repair or replacement caused by events beyond its reasonable control, including but not limited to supply constraints and carrier delays.

WHAT THIS WARRANTY DOES NOT COVER

This limited warranty does not cover any defect, damage, or failure resulting from, relating to, or caused by:

1. Normal wear and tear, including cosmetic or aesthetic changes that do not affect function (for example, scratches, dents, tears, surface oxidation, fading, or natural breakdown of colors or materials over time and use).
2. Misuse or abuse, including overloading or use inconsistent with the product’s intended purpose.
3. Failure to follow TerraGnar’s written instructions or guidelines, including instructions included with the product or made available to the original purchaser.
4. Improper assembly, mounting, installation, or maintenance, including failure to perform routine maintenance.
5. Accidents or conditions beyond TerraGnar’s reasonable control, including but not limited to theft, abuse, negligence, vehicle operation, etc.
6. Modifications, alterations, or repairs not performed by TerraGnar or not performed in accordance with TerraGnar’s written instructions.
7. Commercial or non-personal use, including but not limited to commercial, professional, rental, ride-share, fleet, institutional, or other non-residential/non-household use.
8. Damage to non‑TerraGnar products, including but not limited to any property such as vehicle, tailgate, bicycle and/or components, other vehicles, etc., and/or items transported using, carried on, or used in conjunction with TerraGnar products, including but not limited to vehicle, tailgate, bicycle and/or components, other vehicles, etc.
9. Use on unapproved vehicles or in unapproved locations/conditions, if prohibited by TerraGnar’s written instructions.
10. Any other negligent, reckless, or improper use of any TerraGnar products.
11. No personal injury coverage. This limited warranty does not provide compensation for personal injury.

LIMITATION OF LIABILITY

The remedies described in this document are your sole and exclusive remedies. Except as prohibited by law, under no circumstances will our liability exceed the actual amount paid by you for the defective product for claims arising under this Limited Warranty.

This warranty is expressly made in lieu of any and all other express warranties, whether oral or written. Any implied warranties that may be applicable to products, including implied warranties of merchantability or fitness for a particular purpose, are limited to the duration of this warranty.

TerraGnar’s sole liability is limited to the remedy set forth above. To the maximum extent permitted by law, TerraGnar will not be liable for any incidental, consequential, indirect, special, exemplary, or punitive damages (including lost profits or lost sales).

WARRANTY CLAIM PROCESS

To initiate a claim, the original purchaser should contact TerraGnar via e-mail at support@terragnar.com. TerraGnar will acknowledge receipt within 15 business days and provide instructions. You must provide: (1) description of the defect; (2) photos; and (3) proof of purchase. Acceptable proof includes an order confirmation, invoice, or receipt showing seller, product, and purchase date. If unavailable, TerraGnar may accept serial numbers and other documentation reasonably establishing purchase.

TerraGnar will determine coverage within 30 business days after acknowledgement of receipt and receiving all required information. If product return is required and TerraGnar’s preliminary review indicates a likely covered defect, TerraGnar will provide a prepaid shipping label; otherwise, you are responsible for shipping. If coverage is later confirmed, TerraGnar will reimburse reasonable ground shipping costs you incurred.
